Nelson Mullins has an active appellate practice in federal and state courts throughout the Southeast. As a part of this practice, members of the Firm's litigation practice groups are often asked to file amicus curiae briefs in state and federal courts on behalf of industry groups. Firm attorneys regularly appear before appellate courts in Georgia, South Carolina, and North Carolina, as well as in the U.S. Courts of Appeal for the Fourth and Eleventh Circuits. Firm litigation attorneys have also appeared before the U.S. Supreme Court. Drawing from that experience, the Firm's appellate practitioners are strong believers in the value of focused and persuasive advocacy (both written and oral) and are sensitive to the public policy role of the appellate courts.
The Nelson Mullins appellate practitioners include several former law clerks to judges and justices of federal and state appellate courts. These practitioners understand the internal operating procedures of the courts and have insight into how decisions are reached.
The Firm's appellate practitioners are members of various appellate practice organizations, and are authors and speakers on appellate practice. They understand and are often called upon to engage in extraordinary writ practice and other emergency relief actions.
Nelson Mullins appellate practitioners are also called upon to assist with preservation of error issues and to help position certain cases for appeal during trial. They are also frequently consulted on matters regarding appealability of various orders and rulings.
